1. Definitions & Scope

These Terms of Service ("Terms") govern your access to and use of the products, services, websites, and applications (collectively, the "Services") provided by Dyuvik ("we," "us," or "our"). Dyuvik operates under the stewardship of Bhanuprakash Reddy Yanamala, serving as the primary data controller and legal entity representative.

Our core Services include, but are not limited to:

  • Ages & Spices (agesandspices.com): An AI-powered culinary platform providing recipes and interactive AI Sous-Chefs.
  • DarkLens (darklens.dev): An AI-driven dark pattern scanning and detection tool, accessible via web and browser extensions.
  • Marquee (joinmarquee.com): A cinematic entertainment social network featuring a virtual Box Office economy and AI-generated content tools.

2. Acceptance of Terms

By creating an account, accessing, or using any of the Services provided by Dyuvik, you expressly agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you are prohibited from using or accessing our Services. These Terms constitute a legally binding agreement between you and Dyuvik.

3. Product-Specific Terms

3.1 Ages & Spices

Ages & Spices provides access to culinary content, recipes, and AI-powered interactions. You understand and agree that dietary information, nutritional data, and culinary advice generated by AI Sous-Chefs are for informational purposes only. We do not guarantee the accuracy, completeness, or safety of any recipe or AI-generated advice. You remain solely responsible for ensuring that prepared food meets your dietary requirements and health standards.

3.2 DarkLens

DarkLens is a diagnostic tool designed to identify potential deceptive design patterns on digital interfaces. While we strive for high accuracy through our proprietary AI models, we make no representations or warranties regarding the completeness or absolute correctness of the scans. The results provided by DarkLens do not constitute legal advice or a definitive compliance assessment. You are solely responsible for compliance with consumer protection and privacy laws applicable to your digital properties.

3.3 Marquee

Marquee operates as a social network and virtual economy platform. The platform features virtual currency ("Box Office Tickets"), which holds no real-world monetary value and cannot be redeemed for fiat currency. You retain ownership of the original content you post, but you grant Dyuvik a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods. AI-generated content produced via Marquee tools is subject to the usage policies of our underlying AI providers (e.g., Google Gemini, Replicate).

4. Intellectual Property

The Services and their original content, features, functionality, and design elements—including but not limited to the Dyuvik brand, Ages & Spices, DarkLens, and Marquee trademarks, service marks, logos, and proprietary algorithms—are and will remain the exclusive property of Dyuvik and its licensors. Our intellectual property is protected by copyright, trademark, and other laws of both India and foreign countries. You may not use our intellectual property without our prior written consent.

5. User Conduct

You agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the Services in any medium, including without limitation by any automated or non-automated "scraping"; (ii) using any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the Services; (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services; and (v) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure.

6. Payment & Billing

Certain aspects of the Services are provided for a fee or other charge. If you elect to use paid aspects of the Services, you agree to the pricing and payment terms as we may update them from time to time. Dyuvik uses Paddle as our Merchant of Record for all transactions. By completing a transaction, you agree to Paddle's Terms of Service and Privacy Policy. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

7. Limitation of Liability

IN NO EVENT SHALL DYUVIK, ITS FOUNDER, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

8. Indemnification

You agree to defend, indemnify and hold harmless Dyuvik and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

9. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts located in India.

10. Severability, Waiver, & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

11. Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
